Welcome to Volus ("we," "our," or "us"). These Terms of Service ("Terms") govern your access to and use of the Volus platform, including our website, API, and related services (collectively, the "Service").

By accessing or using our Service, you agree to be bound by these Terms. If you disagree with any part of these Terms, you may not access the Service.

2. Acceptable Use

Fair, respectful, and lawful use is required.

You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree not to:

  • Reverse engineer, decompile, or attempt to extract the source code of the Service.
  • Resell, sublicense, or redistribute the Service without authorization.
  • Use the Service to engage in any fraudulent, abusive, or illegal activity.
  • Interfere with or disrupt the Service or servers or networks connected to the Service.
  • Use automated means to access the Service without our express written permission.
  • Violate any applicable laws or regulations in your use of the Service.

3. Accounts & Access

Security and authenticity keep everyone protected.

  • You must provide accurate, current, and complete information during registration.
  • You are responsible for safeguarding your account credentials and for all activities under your account.
  • You must notify us immediately of any unauthorized access or security breach.
  • We reserve the right to suspend or terminate your account for violations of these Terms, suspicious activity, or security concerns.
  • One person or entity may not maintain multiple accounts without authorization.

4. Service Availability & Uptime

We aim for reliability, with reasonable limits.

  • The Service is provided "as is" and "as available" without warranties of any kind.
  • We strive for high availability but do not guarantee uninterrupted access.
  • Scheduled maintenance will be communicated in advance when possible.
  • We are not liable for any indirect, incidental, or consequential damages arising from service interruptions.

5. Data Ownership & Usage

Your data stays yours; insights are licensed for use.

  • Your Data: You retain all ownership rights to your Connected Commerce Data.
  • License to Us: You grant us a limited license to process your data solely to provide the Service.
  • Aggregated Data: We may use aggregated, anonymized data to improve our AI models and Service.
  • Prohibited Data: Do not upload unlawful, infringing, or highly sensitive personal data without proper safeguards.

6. Billing & Subscriptions

Transparent pricing and flexible billing.

  • Subscription fees are charged monthly or annually based on your selected plan.
  • All payments are processed securely through Stripe.
  • Fees are non-refundable unless required by law or stated in your agreement.
  • You may cancel your subscription at any time; cancellation takes effect at the end of the billing period.
  • We reserve the right to change pricing with 30 days' notice.
  • Applicable taxes may be added based on your location.

7. API Usage & Fair Use

Protect shared infrastructure for all customers.

  • API keys are personal and confidential. Do not share them publicly.
  • Rate limits apply to ensure fair usage and system stability.
  • Excessive API requests that degrade service performance may result in throttling or suspension.
  • Automated scraping or testing that harms infrastructure is prohibited.

8. Intellectual Property

All intellectual property rights in the Service, including but not limited to software, algorithms, trademarks, and content, are owned by or licensed to Volus.

You may not copy, modify, distribute, or create derivative works based on the Service without our express written permission.

9. Limitation of Liability

To the maximum extent permitted by law, Volus shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities.

Our total liability for any claim arising from these Terms or the Service shall not exceed the amount you paid us in the 12 months preceding the claim.

10. Termination

  • You may terminate your account at any time through your account settings.
  • We may suspend or terminate your access immediately if you breach these Terms.
  • Upon termination, your right to access the Service ceases, and we may delete your data per our retention policy.

11. Governing Law & Disputes

We aim to resolve issues quickly and fairly.

These Terms are governed by the laws of Delaware, USA, without regard to conflict of law principles.

Any disputes arising from these Terms or the Service shall be resolved through good faith negotiation. If unresolved, disputes may be brought in state or federal courts located in Delaware.
